Terms of Service

Welcome to TravelTube! These Terms of Service (“Terms”) govern your use of the TravelTube platform, including our website, mobile applications, and other services (collectively, the “Service”), provided by TravelTube, Inc., a Delaware-registered company with its operational head office in Tallinn, Estonia. By using our Service, you agree to these Terms. If you do not agree, please do not use our Service.

1. Services Provided

TravelTube offers a platform for users to:

1. Discover and Book Hotels and Restaurants: Users can search, view, and make reservations for hotels and restaurants.
2. Merchant Services: Merchants can register on TravelTube to list their hotels, restaurants, and related services.
3. Arrival Box Services: Selected merchants may offer an “Arrival Box” service, allowing travelers to pre-purchase kits or packages to be delivered on arrival.
4. User Accounts: Users can create accounts to manage bookings, payments, and preferences.
5. Payments and Transactions: TravelTube facilitates payments between users and merchants through our secure payment system.
6. Handshake Policy: Certain services require a decentralized app handshake with travelers to confirm the service was received. This is mandatory to prevent disputes and confirm the completion of services.

2. User Responsibilities

As a user of TravelTube:

1. You must be at least 18 years old to use the Service.
2. You are responsible for maintaining the confidentiality of your account credentials.
3. You must provide accurate, current, and complete information when creating accounts or making transactions.
4. You agree to comply with all local laws regarding bookings, payments, and other uses of the Service.
5. Any fraudulent activity, misuse, or violation of these Terms may result in suspension or termination of your account.
6. Users may submit reviews only after making payment to the merchant or confirming check-in/handshake with the merchant.

3. Merchant Responsibilities

Merchants using TravelTube agree to:

1. Provide accurate information about services, availability, pricing, and offers.
2. Fulfill all bookings and services purchased through TravelTube in a timely and professional manner.
3. Comply with all applicable laws, regulations, and industry standards.
4. Perform the decentralised app handshake with travelers to confirm service delivery. Failure to perform the handshake may lead to dispute claims.
5. Pay applicable transaction fees as set out in Section 4.

4. Fees and Charges

1. Standard Transaction Fee: TravelTube charges a transaction fee of 0.6% for every merchant for bookings and transactions made through the platform.
2. Arrival Box Services: Merchants offering the Arrival Box service will incur an additional 5% service fee on top of the standard transaction fee.
3. Fee Deduction: Transaction fees will be deducted automatically from the merchant’s earnings.
4. Changes to Fees: TravelTube reserves the right to update transaction fees with 30 days’ notice to merchants.

5. Payment Terms

1. Payments from users to merchants are processed securely via the TravelTube payment system.
2. TravelTube is not responsible for any delays or errors caused by payment processors or banks.
3. Merchants must ensure their bank or payment details are correct to receive payouts.

6. Reviews and Ratings Policy

1. Users can submit reviews only after payment or handshake/check-in confirmation with the merchant.
2. Merchant review averages are calculated after 10 submitted reviews.
3. Account suspension rules based on review scores:
   • Average rating below 4.0: Account suspended for 24 hours
   • Average rating below 3.5: Account suspended for 3 days
   • Average rating below 3.0: Account suspended for 7 days, after which the system resets the merchant review average
4. Merchants are responsible for providing quality service to maintain good reviews.

7. Cancellation and Refunds

1. Cancellation and refund policies may vary depending on the merchant.
2. TravelTube is not liable for refunds or disputes between users and merchants beyond facilitating the transaction.
3. Merchants are responsible for honoring their stated cancellation and refund policies.

8. User Content

1. Users may post reviews, photos, and feedback regarding their experiences.
2. By posting content, users grant TravelTube a worldwide, royalty-free, non-exclusive license to use, reproduce, and display that content on the platform or for marketing purposes.
3. Users are solely responsible for the content they post and may not post illegal, defamatory, or offensive material.

9. Intellectual Property

1. All content, branding, logos, designs, and software on TravelTube are owned by TravelTube or its licensors.
2. Users and merchants may not copy, reproduce, or use TravelTube intellectual property without prior written permission.

10. Limitation of Liability

1. TravelTube provides the Service “as is” and does not guarantee the accuracy, reliability, or availability of merchants, hotels, or restaurants.
2. TravelTube is not liable for any direct, indirect, incidental, or consequential damages arising from the use of the Service, including but not limited to:
   • Booking errors or cancellations
   • Payment disputes
   • Personal injury or property damage at merchant locations

11. Dispute Resolution

1. Users and merchants agree to first attempt to resolve disputes informally by contacting [email protected].
2. Any unresolved disputes will be governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles.

12. Termination

1. TravelTube may suspend or terminate accounts at any time for violations of these Terms, including failure to perform handshake confirmation or poor review scores.
2. Users or merchants may terminate their accounts by providing written notice to [email protected].
3. Termination does not relieve users or merchants of obligations incurred prior to termination, including fees or dispute resolution.

13. Privacy and Data Protection

TravelTube collects and processes personal data according to our Privacy Policy, which is incorporated by reference. Users and merchants consent to the collection, use, and storage of personal information as described in the Privacy Policy.

14. Changes to Terms

TravelTube may modify these Terms at any time. Users and merchants will be notified of significant changes via email or platform notifications. Continued use of the Service constitutes acceptance of the updated Terms.
